These Terms of Service ("Terms") govern your access to and use of the ModelCost platform, website, SDKs, and related services (collectively, the "Service") provided by ModelCost ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

By creating an account or using the Service, you confirm that you are at least 18 years old and have the legal authority to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

ModelCost provides AI cost visibility and control tools, including real-time cost dashboards, budget enforcement, anomaly detection, usage attribution, and billing management. The Service includes web-based dashboards, REST APIs, and client SDKs for Python, Node.js, and Java.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials, including API tokens. You agree to notify us immediately of any unauthorized use of your account. We are not liable for losses arising from unauthorized use of your credentials.

Each account belongs to an organization. You may invite team members to your organization, and you are responsible for their compliance with these Terms.

4. Billing and Payment

Paid plans are billed monthly in advance. All plans include a 14-day free trial. You may cancel at any time, and cancellation will take effect at the end of the current billing period. We do not provide refunds for partial billing periods.

We reserve the right to change pricing with 30 days' notice. Continued use of the Service after a pricing change constitutes acceptance of the new pricing.

The Service and its original content, features, and functionality are owned by ModelCost and are protected by copyright, trademark, and other intellectual property laws. Our SDKs are provided under the terms specified in their respective repositories.

You retain all rights to your data. By using the Service, you grant us a limited license to process your usage metadata solely for the purpose of providing the Service.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Cost calculations are based on the data you send through our SDKs and publicly available pricing information; we do not guarantee the accuracy of cost figures.

8. Limitation of Liability

To the maximum extent permitted by law, ModelCost shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, and limitation of liability.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in Delaware.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
